About collective bargaining

Collective bargaining occurs when a group of people in a workplace band together to increase their negotiating power.

Your bargaining team

Member-driven bargaining teams are a crucial part of securing a strong collective agreement.

The bargaining team represents the collective voice of all AMAPCEO-represented employees at the bargaining table and works to negotiate the best collective agreement possible.

We will need to elect a Bargaining Team from amongst our colleagues in our workplace to represent us in negotiations with our employer. 

Typically, bargaining teams are composed of two members, as well as additional AMAPCEO staff and legal counsel. AMAPCEO encourages applications from across all divisions at the IPC and no prior bargaining experience is required.

Eligibility and application process

To be eligible to vote and/or run for election, you must be a member in good standing. “A member in good standing” means you must have filled out an application for membership (the blue union card that was signed in order to form your union).

Nominations will open Tuesday, August 8 at noon ET and close on Tuesday, August 15 at noon ET.

Nominations must be made in writing via email to AMAPCEO Benjamin Rossiter at  rossiter@amapceo.on.ca. 

Each nomination must include a brief biographical description/statement of issues prepared by the nominee which will be included in the online election materials. 

If there are more than two nominees, an election by secret ballot for the two preferred nominees will be conducted amongst the bargaining unit members. The two candidates who receive the most votes will be elected.

Bargaining team elections will be held online from noon ET on Wednesday, August 23 to noon ET on Friday, August 25 and conducted by a trusted, confidential third-party provider.

Results will be announced by email.

Bargaining team member: Position description

Role and purpose

To work with other team members, AMAPCEO staff, and assigned legal counsel to negotiate the best collective agreement possible for the membership that honours the bargaining mandate.

Duties and responsibilities

Note: This is an illustrative, but not exhaustive, list of the general duties and responsibilities of a bargaining team member.

1. Before bargaining:

  • Attend and participate in all pre-bargaining training sessions with other team members and assigned staff.
  • Review all related training and background materials, such as research documents, membership survey data, statistical analysis, and reports, etc., to better understand bargaining issues and trends, as well as membership attitudes and desires, going into bargaining. 
  • Make recommendations to the Executive and the Board of Directors on a list of general or broad bargaining priorities.
  • Conduct additional research and analysis of specific bargaining priorities to assist with the development or refinement of AMAPCEO’s initial bargaining proposals.
  • Assist with the rating and ranking of bargaining priorities and proposals to be tabled with the Employer in bargaining, as well as in setting an overall bargaining strategy.

2. During bargaining:

  • Prepare for and participate in all bargaining team meetings and discussions, and any Caucus committees/working groups to which you are assigned.
  • Attend assigned negotiating sessions with the employer, and perform some or all of the following duties:
    • Accurately document what was said/done at such meetings;
    • Observe and report on meeting dynamics, such as non-verbal communications
    • Act as a sounding board to gauge membership reaction to employer proposals.
  • As part of the larger team, or as part of a caucus committee/working group, work with assigned staff and legal counsel to:
    • Analyze the employer’s approach, positions, and proposals;
    • ​​​​​​​Develop effective ideas to advance AMAPCEO’s interests, including refining bargaining proposals; and​​​​​​​
    • Work collegially, diplomatically, and strategically with bargaining team colleagues, staff, and counsel in a process characterized by potentially highly stressful and conflict prone working conditions.
  • If requested to do so, support efforts to mobilize the membership by:
    • Participating in bargaining related communications activities (i.e. appearing in photographs, videos, bargaining updates, news conferences, etc.), membership rallies, and other forms of activism to assist in broadcasting the union’s bargaining goals and messages;
    • ​​​​​​​Attending membership meetings and/or conferences with elected officials or staff to educate, inform, and update members on bargaining issues.
  • ​​​​​​​Assist in the preparation of bargaining team reports and recommendations to AMAPCEO decision-making bodies, such as the Executive and/or the Board of Directors

3. After bargaining:

  • Support, as requested, in AMAPCEO’s efforts to communicate the content of the tentative agreement and the Board’s rationale on whether to ratify the agreement.

Other duties and responsibilities as required.

Time commitment

Bargaining team members should be willing to take paid leave, either continuously or intermittently, for an indeterminate period of time, continuing through to the settlement of a renewed collective agreement. The team members must be willing and available to work extended and/or non-traditional hours throughout the bargaining period, sometimes with very little notice.

 

It is strongly recommended that bargaining team members also be willing to fulfill the roles of:

  1. the workplace representatives for the new bargaining unit; and
  2. the members on the joint labour relations/employee relations committee. 

Due to the “freeze” that applies during bargaining, all aspects of the joint labour relations/employee relations committee will be assumed by the bargaining committee acting as a whole throughout the bargaining process.

What is collective bargaining?

Collective bargaining occurs when a group of people in a workplace band together to increase their negotiating power. There is a greater likelihood of success together than there is apart, so it is also about demonstrating our collective will and resolve.

These negotiations between employees and management lead to a legally binding collective agreement that details many of the terms and conditions of our employment, including wages, working conditions, job security, and more.

This collective agreement also ensures the employer consults with us and that we work collaboratively to seek solutions on matters that affect us. It means our workplaces are governed with transparency and fairness.

When does bargaining start?

Our existing terms and conditions of employment remain frozen in place until a new collective agreement comes into effect. The new agreement may have retroactive measures.

How will I get updates during bargaining?

Make sure your contact information with AMAPCEO is up-to-date and that you are signed up to receive AMAPCEO emails. 

We will also continually update this webpage and the IPC home page with updates as they become available. And the union’s leadership will meet with members either virtually or in-person to update members on progress.

How will our bargaining goals be set?

Your bargaining team will conduct a survey amongst the IPC bargaining unit to identify bargaining priorities and issues of concern.  

The bargaining team will analyze this information, put together a bargaining priorities document, and then meet with the unit again for feedback on this document

Why is it important to support my colleagues and union during bargaining?

Supporting your colleagues, the bargaining team, and our union, helps demonstrate our collective strength and our resolve to securing a fair contract. We are stronger together.

Union leadership and local AMAPCEO activists may also ask you to take specific actions to demonstrate your solidarity. This could include displaying a flag on your desk, using a union background during a video call, or attending an event.

These actions serve as proof of member cohesion and support for AMAPCEO. This can speed up the bargaining process and result in improved collective agreements for all members.
